Who qualifies as a dependent under spending accounts and insurance benefits?

Want to make sure your insurance covers your loved ones, but don’t know who qualifies as a dependent? We can help.

A dependent is any person you claim on your income tax return.

The following people are always considered eligible dependents

Your spouse

Your wife or husband. You must be legally married under Federal law.

Your child

A person 25 years old or younger who is one of the following:

  • Your biological child

  • Your step-child

  • Your legally adopted child

  • Your foster child

  • Your legal ward

  • Your domestic partner’s child

The following people may be considered eligible dependents

Your domestic partner

A domestic partnership is two people of the same or opposite sex who live together but aren’t married. Your employer may only recognize domestic partnerships that are registered with a state of local government.

Who doesn’t qualify?

Some examples of who doesn’t qualify as a dependent are your:

  • Cousins

  • Aunts and uncles

  • Parents

  • Grandparents

  • Siblings
